1. Definitions
- "We / Us / Our" — Warisan Mekar, a financial education provider registered in Malaysia
- "You / User" — any individual who visits our website or enrols in our programmes
- "Service" — the financial education programmes offered by Warisan Mekar
- "Programme" — any specific course offered by Warisan Mekar, including Personal Cash Flow for the Over-40s, Tax Literacy for Malaysian Households, and Shariah-Compliant Investing Foundations
- "Content" — all educational materials, recordings, workbooks, and digital or printed resources provided as part of a Programme
- "Agreement" — these Terms & Conditions, read together with our Privacy Policy and Cookie Policy
2. Acceptance of Terms
By accessing our website or enrolling in any of our Programmes, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and have read and understood these Terms & Conditions. If you do not agree with any part of this Agreement, please do not use our services.
3. Description of Services
Warisan Mekar provides structured financial education programmes delivered online, designed for Malaysian adults aged 40 and above. Our current Programmes are:
- Personal Cash Flow for the Over-40s (6 weeks)
- Tax Literacy for Malaysian Households (8 weeks)
- Shariah-Compliant Investing Foundations (14 weeks)
Programme availability, scheduling, and content may be updated from time to time. We reserve the right to modify Programme formats or delivery methods with reasonable notice to enrolled learners.
4. Enrolment
4.1 How to Enrol
Enrolment in a Programme is confirmed upon receipt of full payment (or an agreed payment arrangement) and a confirmation message from Warisan Mekar. Submitting an enquiry form does not constitute enrolment.
4.2 Eligibility
Our Programmes are designed for adults who are residents of Malaysia. Learners outside Malaysia are welcome to enquire, and we will advise whether a particular Programme can be accommodated.
4.3 Account and Access
Enrolled learners will receive access credentials for session links and digital materials. These credentials are for your personal use only and must not be shared with others.
5. User Responsibilities
- Participate in sessions in good faith and treat facilitators and other participants with respect
- Not record, reproduce, or distribute Programme sessions or materials without our written consent
- Keep your access credentials confidential
- Provide accurate information at the point of enquiry and enrolment
- Not use our website or Programme content for any unlawful purpose
6. Intellectual Property
All Programme content — including session recordings, workbooks, reference guides, printed materials, and website content — is the intellectual property of Warisan Mekar. Enrolled learners are granted a personal, non-transferable, non-exclusive licence to use these materials for their own educational purposes during and after the Programme. You may not copy, distribute, sell, or adapt these materials for any commercial or public purpose.
7. Payment Terms
7.1 Fees
Programme fees are stated in Malaysian Ringgit (RM). Applicable fees are those published at the time of enrolment. We reserve the right to update fees for future cohorts.
7.2 Payment
Payment may be made by bank transfer or such other methods as we make available. Full payment is expected prior to Programme commencement unless a payment arrangement has been agreed in writing.
7.3 Refunds
If you withdraw before the Programme commences, we will refund the full fee less any administrative costs incurred. After the Programme has commenced, refunds will be considered on a case-by-case basis, taking into account the proportion of content completed and the circumstances of withdrawal. 7.4 HRDC Claims
Warisan Mekar is registered with the Human Resource Development Corporation (HRDC). Learners whose employers are HRDC contributors may be eligible to claim Programme fees. We can provide documentation to support such claims upon request.
8. Programme Delivery
- Sessions are delivered online via video conferencing and are recorded for enrolled learners
- Printed materials (where applicable) are mailed to the address provided at enrolment
- Warisan Mekar reserves the right to reschedule individual sessions with reasonable advance notice
- In the event of a facilitator's unavailability, a qualified substitute facilitator will be provided
9. Disclaimers
Our Programmes are educational in nature and do not constitute financial advice. Warisan Mekar is an education provider, not a licensed financial adviser. Content in our Programmes is designed to build understanding and literacy — not to recommend specific financial products, investments, or courses of action for any individual's circumstances.
While we take care to ensure our content is accurate and up to date with Malaysian regulations, we make no representations as to the completeness or accuracy of the content for any specific learner's situation. You should seek independent professional advice before making financial decisions.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Warisan Mekar's total liability to any learner for any claim arising out of or related to a Programme shall not exceed the amount of the Programme fee paid by that learner. We shall not be liable for indirect, incidental, or consequential losses, including loss of income or financial loss resulting from decisions made by a learner following completion of a Programme.
11. Indemnification
You agree to indemnify and hold harmless Warisan Mekar, its facilitators, and employees from and against any claims, costs, or losses arising from your breach of these Terms or your misuse of Programme materials.
12. Termination
Warisan Mekar reserves the right to remove a learner from a Programme, without refund, where that learner has engaged in conduct that disrupts the learning environment, breaches these Terms, or is abusive towards facilitators or other participants. A learner may withdraw from a Programme at any time by notifying us in writing. Refund eligibility is governed by Section 7.3.
13. Dispute Resolution
If you have a complaint or dispute, we ask that you contact us at [email protected] in the first instance. We will make reasonable efforts to resolve the matter within 14 working days. These Terms are governed by the laws of Malaysia. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Malaysia.
14. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Warisan Mekar in relation to our services
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force
- Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future
- Assignment: You may not assign your rights or obligations under these Terms without our written consent
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to enrolled learners by email and indicated by an updated "Last Updated" date above. Continued enrolment or use of our website after changes become effective constitutes acceptance of the updated Terms.
